Support from WIPO, EUIPO, IPO in the field of intellectual property protection and mediation

Cooperation with WIPO

The WIPO Center is a neutral, international, non-profit dispute resolution provider specializing in commercial IP and technology disputes. The WIPO Center actively assists parties in submitting disputes to the WIPO ADR procedures; assists in the selection of a specialized mediator, arbitrator(s) or expert from the WIPO Center database or otherwise, and in the determination of the neutral’s fees; and manages case communications and finances.

To assist in the time- and cost-effective administration of proceedings under its rules, the WIPO Center provides parties with a range of online case management options, including online documentation and online tools for negotiations and hearings, free of charge. The WIPO Center also makes available the WIPO Checklist for Online Mediation and Arbitration Proceedings.

In November 2020, a memorandum of cooperation was signed between the World Intellectual Property Organization and the Industrial Property Office in the area of ​​alternative dispute resolution of intellectual property rights.

Cooperation with EUIPO

The IP Mediation Center Prague systematically collects knowledge support not only from the World Intellectual Property Organization (WIPO), but also from the European Patent Organization (EPO), the European Union Intellectual Property Office (EUIPO) and the Industrial Property Office (ÚPV) in the field of intellectual property protection and dispute resolution related to it through mediation. To this end, it closely cooperates with all these organizations and consults with them on the possibilities and methods of effective use of alternative dispute resolution in the field of intellectual property rights.

The European Union Intellectual Property Office (EUIPO) provides the IP Mediation Center Prague with knowledge support, particularly in the area of ​​training mediators and assistance in creating rules for the institute's activities and conducting mediations in the field of IP in the Czech Republic.

Cooperation with the Industrial Property Office

The IPO is actively seeking ways to incorporate the use of ADR methods into processes related to the protection of intellectual (and especially industrial) property, both in proceedings before the IPO and in subsequent proceedings. Thanks to cooperation with the World Intellectual Property Organization (WIPO) and the European Union Intellectual Property Office (EUIPO), the IPO has the opportunity to use their knowledge support and provide a professional platform for specialized mediators in the Czech Republic.

 

The IPO supports the establishment of ADR services at the national level, raising awareness of ADR services among users of the intellectual property protection system, and strengthening cooperation with other partners at the international, regional, and national levels.

 

The aim is to assist in the area of ​​intellectual property in settling highly professional disagreements and disputes that arise in relation to the creation, application and evaluation of intellectual property objects, particularly in matters of inventions, industrial designs, utility models, improvement proposals, production and operational experience (know-how), unfair competition, trademarks, indications of origin of goods, computer programs and other objects of copyright protection and related rights.
